As Jim speculates on his index card, it's an all-reprint issue.
The fun with ACE comics is, you know when it's a reprint.
Because they switched completely to Leroy lettering in the summer of 1952.
Any book after that date with handlettering has got to be a reprint.
Though I don't know from where... We may know when all the PENALTIES will be indexed.

And I concur with Jim, it IS Marty Rose - and the missing one should be Sy Grudko.
No idea about the cover, though!
Very strange and clumsy - look at the gangster's feet.
Small wonder the police is catching up with him.

On the third story there is that strange "swipe artist" again we encountered in ACE horror, Jim.
You give three suspects: Gates, Ravielli, Bean. From what I've seen and checked on GDC and DCM, I'd go for Louis Ravielli.
But I just know too little.
